Terms of Service — Post Architect

1. Agreement to Terms

By accessing or using Post Architect ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is operated by Post Architect ("we", "us", or "our").

2. Description of Service

Post Architect is a SaaS platform that helps businesses generate, schedule, and publish social media content. The Service uses AI (powered by Anthropic's Claude) to generate content based on information you provide about your business, and can automatically publish posts to connected social media accounts (Facebook and Instagram) on your behalf.

3. User Accounts

You must create an account to use the Service. You are responsible for:

Maintaining the confidentiality of your login credentials
All activity that occurs under your account
Providing accurate and complete information during registration
Notifying us immediately of any unauthorized use of your account

4. Subscriptions and Billing

The Service offers paid subscription plans billed monthly through Stripe. By subscribing:

You authorize us to charge your payment method on a recurring monthly basis
Subscription fees are non-refundable except as required by law
You may cancel your subscription at any time through the Stripe Customer Portal; access continues until the end of the current billing period
We reserve the right to change pricing with 30 days' notice
Each plan includes a monthly limit on AI-generated posts; unused posts do not roll over

5. AI-Generated Content

The Service uses AI to generate social media content. You understand and agree that:

AI-generated content may require review and editing before use
You are solely responsible for reviewing, approving, and publishing all content
We do not guarantee that AI-generated content will be accurate, appropriate, or suitable for your specific needs
You should not publish AI-generated content without reviewing it first
We are not liable for any consequences of publishing AI-generated content

6. Intellectual Property

You retain ownership of all content generated through the Service using your business information. You grant us a limited license to process, store, and transmit your content solely for the purpose of providing the Service. We retain ownership of the Service itself, including its design, code, and underlying technology.

7. Acceptable Use

You agree not to use the Service to:

Generate or distribute spam, misleading, or deceptive content
Create content that is illegal, harmful, threatening, abusive, or hateful
Violate any applicable laws or regulations
Infringe on the intellectual property rights of others
Attempt to gain unauthorized access to the Service or other users' data
Reverse-engineer, decompile, or attempt to extract the source code of the Service
Use automated means to abuse the Service beyond normal usage

8. Social Media Platform Terms

When connecting your social media accounts (Facebook, Instagram), you remain bound by those platforms' terms of service. We act as an authorized tool on your behalf but are not responsible for any actions taken by those platforms regarding your accounts or content.

9. Limitation of Liability

To the maximum extent permitted by law, Post Architect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account and associated data by contacting us.

12. Changes to Terms

We may update these terms from time to time. We will notify you of material changes by posting the updated terms on this page with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated terms.
